What is the Procedure for Chapter 7 Bankruptcy?

♦  You will meet with one of our Bankruptcy specialists.  They are trained to work with you to analyze the best solution for your financial problems.  We need to get a picture of your income, your bills, your living expenses, and any special needs you may have.

♦  You should bring information showing your income for the last several months, any court papers relating to your bills, and a copy of last year taxes if filed. 

♦  Once the attorneys fees are paid, you have completed the first class, and all your documents have been submitted your case will be prepared for the attorney to review. 

♦  You will meet with one of our attorneys to verify your information.

♦  Your case will be filed and a court date is set.

♦  Your court case (called a 341 meeting) will take place approximately one month after filing.  You are required to attend.

♦  Approximately 90 to 120 days after the court date, you should receive the final discharge.

An "automatic stay" is granted by the court to prevent your creditors from pursuing collection activities against and communication with you.  

Which Assets Do I Keep after Filing a Chapter 7?

You will have to meet certain criteria to show if you are eligible to keep your home, automobile, jewelry, and retirement accounts, and other assets.  Colorado exemptions will dictate your specific exemptions .  Our bankruptcy attorneys will help you evaluate whether a Chapter 13 would be a more appropriate course of action.
